THE FTC IS LISTENING

It's great to see that the "little people" are being heard and it's
about time!  These companies weave loopholes throughout their policies and procedures, terms and conditions, etc.  Then they use "scare tactics" such as "lawsuit" to keep you quiet.  Free speech... speak YOUR TRUTH!

It's great to see the FTC in action to PROTECT the consumer through exposing and setting new standards for shady MLM companies.

Here are a few of the articles you might find interesting....

From Truth In Advertising:
FTC SUES WEIGHT-LOSS MARKETERS FOR BLOCKING BAD REVIEWS
September 28, 2015
"Consumers who fail to reach their weight-loss goals with one company’s purported stomach-shrinking powders marketed as an alternative to gastric bypass surgery face threats of litigation and hundreds of dollars in charges if they want to share a negative review of their experience.
Negative posters taken to court
Roca Labs has done more than just threaten to sue. The company has actually taken customers to court for posting negative comments online, the FTC alleges. Not only that, the FTC claims Roca Labs has also dissuaded customers from telling us how they really feel by threatening to charge customers the “full price” of the discounted products that failed to work for them — a difference that amounts to $1,100.
Customers had to agree to the provisions, which were nestled in the company’s terms and conditions,"  read full story here.

PissedConsumer Fights Back Against Roca Labs' Attempt To Silence Customer Complaints
"We recently wrote about a very questionable lawsuit filed by, Roca Labs, a "dietary supplement" company (it apparently prefers "nutraceutical") with a claimed "alternative" to gastric bypass surgery made up of some ingredients that they claim will expand and fill up your stomach so you're not hungry. When you buy, the company "offers" a "discount" if you agree to never, ever say anything bad about the company, ever."   read more from TechDirt here
 From Fraud Files:

I LOVE this site by the way!
"Roca Labs attempts to silence its unhappy users before they even buy the products. The company says that in exchange for a “significant discount” (about $800) off the normal price of $1,580 for the weight loss goop, customers agree to not speak, publish, print, blog or write negatively about the company or products." read the story in full here

I hope this will encourage all who have experienced, (or know someone who has) a negative experience with MLM / Pyramid scams to report it.  The actions by the FTC are because people refused to remain quiet.

Create Awareness.... one person at a time

I was recently contacted by someone who asked me to look at some information about his company.  Below you will find my response to that and his last response to me.

Dear _____,  thanks for reaching out to me, but sounds like you are affiliated with direct sales/MLM/Network Marketing. After my Plexus Worldwide nightmare, I will NEVER do any type network marketing / direct sales or MLM again. I already fell for the "but this one is different" line. No offense to you, but at this point in my life I'm done with them, no matter what they promise. If you're interested, you can read more below and you'll understand why I feel the way I do. My blog is first on the list. You are more than welcome to share... hate to see others get taken by this company.

MLM Judgment Day...who's next?

Ethan Vanderbuilt I cannot thank you enough for your tireless efforts to expose scams like Vemma.

From the desk of Ethan Vanderbuilt....
Judgement day has arrived for Vemma. It is the end of Vemma as it once was.  Vemma was a Multi-level Marketing company.  It is no longer.
After the review of the case by the judge John J. Tuchi, here are some of the key orders and findings about Vemma:
The critical question for the FTC is whether the revenues that primarily support the commissions paid to all participants are generated from purchases of goods and services that are not simply incidental to the purchase of the right to participate in a moneymaking venture.
The evidence before the Court leaves little doubt that the FTC will ultimately succeed on the merits in demonstrating that Vemma is operating a pyramid scheme.  (read the rest of the story here)

The truth is, any MLM company I have been associated with, such as Plexus Worldwide, a person does not get to the top of the food chain or "Diamond" Ambassador by selling product.  You MUST grow your team by recruiting AND you don't get paid on those people you bring in unless they and you are "active" aka:  autoship turned on, minimum order of $100.  Take a look at their summary chart shown below (can also be accessed here).

Also, it states "For complete details, please refer to the "Full Plexus Compensation Plan". HOWEVER, what they DON'T tell you is there is much more than just the compensation plan, there is the good ole "policies and proceedures", but that's an episode for another day.

I was astounded by their severe lack of professionalism when I questioned rank removal of one of my team members, and received the most ignorant, unprofessional responses ever! And they call themselves a company????  They don't even know their own compensation plan!  "Uh, we dunt know whut happened".  Sounds to me like they don't know their nose from the hole in the ground!!

 -------------------------------------------------------------------------------------------------------------------------

If you're interested you can read the rest of the nightmare here.

I say all that to say that most of the MLM's out there lack ethics and integrity, and clearly represent a classic pyramid scheme according to the Vemma Judgement.

FTC, are you watching???   There are many victims of such greedy, unethical MLM Companies waiting for you to bring the hammer down on new regulations regarding this scandalous industry.  I believe the crumbling of the MLM empire has begun....  it's about time.

Vemma's Day In Court

From the desk of Ethan Vanderbuilt....

"On September 15th 2015, Vemma had their chance to defend themselves in court against the claims of the FTC. The Arizona Sandra Day O’Connor Federal Courthouse court room was full of Vemma employees and contractors. B.K. Boreyko and the Vemma defendants had with them 9 lawyers.
Here are the primary complaints against Vemma:
  • Vemma’s business model depends upon recruiting individuals to participate in Vemma as Affiliates and encouraging them to purchase Vemma Products in connection with such participation, rather than selling products to ultimate-user consumers.
  • Through their sales and marketing activities, Vemma misrepresents the nature and income potential of Vemma.  They repeatedly tout that Vemma can provide anyone an easy path to financial freedom and independence.
The day started with the FTC expert witness Dr. Stacie Bosley, an economics professor at Hamline University in Minnesota who studies pyramid schemes worldwide." (read more)

I sure didn't!  Maybe I should contact the FTC  for clarification..
